In the best of all worlds, Abramson said, every couple would consist of partners of equal status, power and attractiveness in an equal partnership. In reality, however, many relationships have imbalances in status, salary, age, attractiveness and other factors. Why, he asks, must the university legislate against them? Should hospitals prevent doctors from being romantically involved with nurses? Should law firms prohibit attorneys from dating law clerks and administrative assistants?
Must judges and senators be romantically involved only with people of similar status? Abramson strongly supports sexual harassment policies to prevent coercion and abuse within relationships but argues that consensual romantic relationships between adults should not be prohibited. But if a year-old graduate student gets involved with a year-old teaching assistant or a year-old assistant professor, and I think that’s much more likely, that relationship is also prohibited by university policy.

If you are above eighteen and have already graduated, dating a former teacher would not be something illegal. And if you have graduated only recently, there may be doubts that you both already shared more than a professional relationship while still at school or at least harbored such intentions. Thus in order to save both yourselves from embarrassment and potential trouble, it is best to keep to a cooling-off period like for instance a year or so after you graduate.

Once representation is complete, the client isn’t a client anymore, so lawyers in ABA Model Rule jurisdictions should be free to date to their hearts’ content. Indeed, just last year, the Louisiana Supreme Court declined to apply to former clients the prohibition on dating current clients. Justice Jeannette Knoll concurred to emphasize that a lawyer’s ethical duties to the client don’t stop just because representation is over: While this duty primarily impacts ongoing representation, the attorney must continue to act in a way so as not to actively harm the former client’s best interests even after the professional relationship ceases.
Just Wait a Little While Lawyers who want to date former clients should thus wait until the entire action is over before starting the relationship. Just because representation ceases doesn’t mean the ongoing duties cease. So how long do you have to wait before you can date a former client? There’s no definitive time period, or even a guideline, except that lawyers should use the action itself, not the representation, as their benchmark, and should use caution.

Now, an increasing number of schools are outright banning relationships – even consensual ones – between professors and undergraduates. I recently left my school to take up a position in another school, and would like to keep in touch with a couple of trustworthy students I have taught who are now 18 and have also left. In the last couple weeks, friend requests have been flooding into my facebook profile, all of them from young adults who are now former students of mine. The first dozen or so were rejected without much thought. They were the same ones who had tried to friend me while I was still their teacher, and were just as quick on the draw once they had graduated.
It was too soon, and to me they were still students. Last night I approved my first former student. Subconsciously they are slipping away into adulthood, and I no longer see them as little kids. Nothing happened right away. All was quiet on the facebook front, and I continued my online life. Of course now I am second guessing myself, and wondering what the significance of that fated click will be.
